New York Labor Law

Coffey Modica has extensive experience and a proven track record handling, trying, and maximizing effective early solutions in complex, high-exposure personal injury claims under New York Labor Law. We combine deep knowledge of Labor Law §§ 240(1), 241(6), and 200 and its constantly evolving case law with a strategic,
results-driven approach — regularly defending property owners, developers, general contractors, and construction managers against the strict-liability standards tied to severe worksite accidents.

Our litigation team aggressively pursues risk transfer and early dismissal, working to minimize or completely eliminate our clients’ exposure long before a case ever reaches a jury, earning a reputation for effective advocacy, practical counsel, and the successful resolution of challenging cases.

Risk Transfer & Indemnification

We treat early risk transfer as the first line of defense — analyzing indemnity agreements, additional-insured obligations, and “arising out of” language; pursuing third-party actions and tenders; and litigating coverage and declaratory-judgment disputes, including OCIP, CCIP, and non-wrap projects. New York’s AVOID Act now requires third-party complaints within 60 days of the answer, compressing the window to identify liable parties — we move immediately on first-notice claims to preserve risk-transfer rights and screen for potential fraud.

Catastrophic Injury Defense

We defend the most serious claims — wrongful death, traumatic brain and spinal-cord injuries, amputations, burns, and electrocutions — including “grave injury” claims under Workers’ Compensation Law § 11, coordinating strategy across parallel civil and Workers’ Compensation proceedings to prevent conflicting outcomes.

Collectively, our attorneys have secured more than 1,000 verdicts in New York Labor Law matters — trial experience that gives our clients real leverage at every stage of a case, from early motion practice through resolution.
